Atomi’s Children’s Privacy Protection Statement

Atomi, Inc. and its affiliates (collectively, “we”, “us”, “our”, or “Atomi”) are committed to protecting the privacy of children (i.e., minors under 13 years of age or such other age provided by applicable law in your country/region of residence)
This Children’s Privacy Statement (including subsequent updates, collectively, this “Statement”), the User Agreement , the Mobile Application and Products Privacy Policy , and the Website(s) Privacy Policy  (collectively, “Agreements”) are intended to explain to children’s parents or other guardians (“guardians” or “you”) how we collect, use and protect children’s data for all of Atomi’s products, websites, services, and mobile application (collectively, “Products and Services”). For all Products and Services, and any other activities and interactions with us, we do not knowingly collect or process the data of any individual under the age of 18 and thus, do not knowingly or intentionally collect the data of children (i.e., minors under 13 years of age). See our Mobile Application Privacy Policy for more information. 
We require affirmative confirmation that the individual is 18 or over prior to creating an account and using our Products, Services, and Mobile Application. We will not knowingly collect information from minors in the United States or elsewhere with or without the consent of their parents or guardians.
If you become aware that children’s or minors’ data may have been inadvertently disclosed to us, please let us know immediately pursuant to the instructions below.
Notwithstanding the above, to the extent minors’ data may be collected, please see the instructions and information below.

Special Instructions for a Guardian:
We protect the personal information and privacy of our users. Our Products and Services are not targeted to minors, and we do not knowingly collect the personal data of minors under the age of 18, including children 13 or younger. You are expected to help us protect the personal information and privacy of minors under your custody by ensuring that any minors are not using our Products and Services or submitting information to us without your affirmative prior consent. Please read and accept this Statement together with any minors to ensure that they use our products and services with your consent and guidance.

Special Instructions for Children:
We do not allow minors or children to use our Products or Services. If you are a child, please be sure to carefully read this Statement with your guardian.
We hereby remind you that you shall carefully read and fully understand this Statement and the Agreements before choosing whether to agree to the terms and whether to agree to your children’s use of our products or services. If you do not agree to any of the terms in the Agreements please do not use our Products and Services.
This Statement applies to our Products and Services, including specific smart devices and their features and scenarios.
The products and services that we provide may include products or services provided by third parties, and you may log in and use such third-party products and services through our software or products. Such third parties may collect, use, or process information and may include the processing of minor data if you provide it to us. For more information on how to delete minors’ data if it was disclosed to us, please see below on how to make a request to delete.

I. What Information Do We Collect?
While Atomi does not intentionally collect or process the data of minors or children, if you provide children or minor data to us, we will protect this data consistent with our obligations to secure all our users’ data. This will be in strict accordance with the obligations and responsibilities for the protection of children’s personal information prescribed by applicable laws and regulations, as well as the provisions of relevant privacy policies and the Agreements, and based on the specific needs of relevant products and services.
If a minor or child uses our products or services including utilizing the Mobile Application, their usage may be collected. Please refer to the “What Personal Information Do We Collect” section of the Mobile Application Privacy Policy  to learn more about other personal information we may collect.
We will not knowingly collect children or minor data, unless you provide prior affirmative consent. If, for any reason, you provide consent and we need to collect additional personal information about your children beyond the above-mentioned scope of collection, we will notify you again and obtain your consent.

II. How Do We Use the Information?
We do not knowingly or intentionally collect or process data of minors or children. To the extent any is inadvertently collected and/or affirmative consent has been provided for the collection, we will, in strict accordance with laws and regulations and the agreements concluded with users, use the information collected from you for the following purposes:
a) To provide necessary products or services or the specific functions thereof; and
b) To optimize products or services, provide security assurance, or conduct service surveys.
If we need to use personal information about you or your children beyond the above-mentioned purposes, we will notify you again and obtain your consent. If you have inadvertently provided children or minor data to us, please contact us immediately at support@atomiusa.com to delete the data.

III. Sharing, Transfer, and Disclosure of Children’s Personal Information
Because we do not collect children or minor data, we do not knowingly share, transfer, or disclose the personal information of children to any third parties.
a) Sharing with Guardians
Because we do not collect children or minor data, we do not knowingly disclose children or minor data to third-parties. To the extent you provide children or minor data to us (and in which consent has been obtained), and/or you may inadvertently disclose children data to us, we will share such personal information with their guardians so that the guardians may access and manage relevant personal information.
b) Disclosure with Third Parties
Because we do not collect children or minor data, we do not knowingly disclose children data to third-parties. To the extent you provide children or minor data to us (and in which consent has been obtained), and/or you may inadvertently disclose children data to us, know that we disclose all Personal Information collected with third-party partners, including service providers, contractors, agents, and application developers (e.g., communications service providers that send emails or push notifications on our behalf, and map service providers that provide us with location services) (they may not be located in your jurisdiction) and have them process such information for us in accordance with our statements and privacy policies and relevant confidentiality and security policies.
We disclose Personal Information collected for the following purposes:
i. To provide our services;
ii. To achieve the purposes as set forth in the “How Do We Use the Information” section hereof;
iii. To fulfill our obligations under the these Agreements; and
iv. To understand, maintain, and improve our services.

We may anonymize the collected information of any individuals for the purpose of big data analysis, for example, generating a report for the services that you use.
c) Other Disclosures
In general, we prohibit the disclosure of minor or children’s personal information, but to the extent you have inadvertently disclosed minor or children personal information to us, please note that it may be disclosed to following third parties consistent with our legal obligations including:
i. To comply with applicable laws and regulations, legal proceedings, or requests from public institutions and government authorities;
ii. To perform our terms of use and other agreements, policies, or standards, including investigating any potential violations;
iii. To protect the rights, privacy, security, or property of us and/or other users, including you; and
iv. To seek available detection, prevention, or remedial measures, limit potential damages payable by us, or resolve security, fraud, or technical issues.

IV. Storage of Children’s Personal Information
Because we do not knowingly collect or process children’s data, we do not knowingly store children’s data either. However, to the extent you provide children data to us, rest assured that the data will be protected consistent with the security standards and technical measures we have enacted for all our users. This data will be stored until you make a request to delete the data or otherwise consistent with our retention policies. V. Management of Children’s Personal Information
We do not intentionally or knowingly collect children’s data. However, if you have provided children’s data to us, you can access, or delete relevant personal information by contacting us at support@atomiusa.com. We will respond to you in a timely manner upon verifying your feedback. Please understand that during the verification process, we may require you to provide certain personal information about the children’s personal information to verify, so that we can continue to respond to your needs after completing authentication and verifying the issues.
a) Accessing Children’s Personal Information
We do not knowingly or intentionally collect children’s data. If you believe your children’s data may have been inadvertently disclosed to and collected by us, you can make a request to access the information collected about you, along with your children’s information.

b) Deleting Children’s Personal Information
We do not knowingly or intentionally collect children’s data. If you believe your children’s data may have been disclosed to us, you can make a request to delete the information collected about you, along with your children’s information. Any request to correct children’s data will be construed as a request to delete such data. We will take measures in a timely manner to delete such personal information after completing the authentication and verification if:
i. we unknowingly collect, store, use, transfer, or disclose the child’s personal information without your consent;
iii. you withdraw your consent; or
iv. you terminate the use of our products or services by cancelling the user account.
For your request, we will perform authentication and verification, and take measures in a timely manner to delete relevant personal information after completing the authentication and verification. If you find that any personal information of your children has been collected without your prior consent, please contact us immediately, and we will endeavor to delete relevant information as soon as possible.
